Introduction

These Terms and Conditions (“Terms”) govern your purchase and use of any services provided by Goddef Performance (“we”, “us”, “our”).

By purchasing, subscribing, accessing, or using any of our coaching services, training programmes, consultations, digital products, or related services, you agree to be legally bound by these Terms.

Goddef Performance is not a medical service, or qualified to issue any medial advice. All services are provided for educational and fitness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. We do not examine, diagnose, or treat medical conditions, or specialise in injury rehabilitation.

You should consult a qualified medical professional before beginning any exercise programme.If you feel pain, dizziness, shortness of breath, or discomfort, stop immediately and seek medial attention, and only exercise once cleared by a medical professional. Engaging in any sort of physical activity is performed entirely at your own risk. You acknowledge that engaging in online coaching, or using any online purchased training program, means your coach is not physically present during exercise, and is unable to make adequate assessment of your exercise.

Goddef Performance is not liable for any accident or injury caused during exercise, by improper use of equipment, negligence, or exercise in any unsafe environment.

2.1 Health & Safety Responsibility

By using or purchasing any Goddef Performance service you confirm the following:

  1. You have not been advised by a medical professional to avoid physical activity.

  2. You do not experience unexplained chest pain, dizziness, or fainting during exercise.

  3. You do not have any medical, joint, bone, muscular, or health condition that would make exercise unsafe.

  4. If pregnant, post-natal, recovering from surgery, or undergoing medical treatment, you have been medically cleared to exercise.

  5. You have disclosed any relevant health conditions, injuries, or limitations prior to beginning services.

  6. You are over 18 years of age at the time of purchase.

2.2 Assumption of Risk

You acknowledge that:

  • Physical exercise carries inherent risks, including injury or illness.

  • Online coaching means your coach is not physically present and cannot directly assess your environment, equipment setup, or exercise technique.

  • That you are confident performing the prescribed exercises, and that you will inform your coach of any difficulties completing these exercises, and seek guidance where necessary.

  • You participate voluntarily and entirely at your own risk.

If you experience pain, dizziness, shortness of breath, or discomfort, you must stop exercising immediately and seek medical advice.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot legally be excluded under UK law

Subject to the above:

Goddef Performance shall not be liable for any indirect, incidental, or consequential loss arising from the use of our services.

Our total liability to you shall not exceed the total amount paid by you for services in the three (3) months preceding the event giving rise to the claim.


Subscriptions & Payments

By subscribing to, or purchasing any service from Goddef Performance you acknowledge and agree to the following:

4.1 Pricing & Currency

  • All prices are listed in Pounds Sterling (GBP £).

  • If purchasing outside the United Kingdom, your bank or payment provider may apply currency conversion or international transaction fees. We are not responsible for such charges.

4.2 Payment Terms

  • All services must be paid in advance, and at least 3 days prior to service starting.

  • Subscription services are billed either monthly or for a fixed term, as agreed at purchase.

  • By purchasing a subscription, you authorise recurring payments using your selected payment method for the agreed billing period.

  • You are responsible for ensuring your payment details remain current and valid.

4.3 Failed Payments

If a payment fails:

  • You will be notified by Goddef Performance.

  • We may reattempt collection up to three (3) times within five (5) days.

  • Access to services may be suspended until payment is successfully received.

We reserve the right to terminate your subscription if payment remains outstanding for more than fourteen (14) days.

Any services scheduled or made available during a period of failed payment may be withheld and will not be refundable or transferable.

All outstanding sums remain payable.

4.4 Subscription Types

4.4.1 Monthly Rolling Subscription

Monthly subscriptions continue automatically on a rolling basis until cancelled.

Payment is collected in advance of each billing cycle.

4.4.2 Fixed-Term Subscription

Fixed-term subscriptions apply for a specified minimum duration (e.g., 3 months).

By purchasing a fixed-term subscription, you agree to fulfil the full payment obligation for the agreed term.

Unless otherwise stated, fixed-term subscriptions do not automatically renew.

4.5 Cancellation Procedure

All cancellation requests must be submitted in writing via email to: tom@goddefperformance.com.

Cancellation will take effect from the date written notice is received and acknowledged, subject to the weekly service structure set out below.

4.6 Billing & Weekly Service Structure

Coaching services are billed monthly but delivered on a weekly basis.

A “service week” runs from:
Monday 00:01 to Sunday 23:59 (UK time).

Weekly services may include, but are not limited to:

  • Programme design and updates

  • Coaching feedback and check-ins

  • Communication and support

  • Any additional services included within your subscription

4.7 When a Service Week Is Deemed Delivered

A service week is considered delivered once coaching services for that week have commenced. This may include programme provision, updates, communication, or any preparatory work carried out on your behalf.

Coaching preparation and programming work is typically undertaken in advance of the service week.

To prevent the upcoming service week from being treated as delivered, cancellation notice must be received no later than 23:59 on the preceding Thursday.

If cancellation notice is received after this point, the upcoming service week will be treated as delivered and will not be refundable.

A service week will be considered delivered where services have been made available to you with reasonable care and skill, regardless of whether you access, engage with, or respond to them.

4.8 Refunds

Upon valid cancellation, you may be entitled to a pro-rated refund for any full remaining service weeks within the current billing period that have not yet been delivered.

No refunds will be issued for:

  • Service weeks already delivered

  • Partial service weeks

  • Failure to access or engage with services made available

4.9 Fixed-Term Subscriptions

For fixed-term subscriptions paid in advance:

  • Full future service weeks that have not yet been delivered may be eligible for refund on a pro-rated basis

  • The current billing period will be assessed in accordance with the weekly delivery structure outlined above

No early termination will relieve you of agreed payment obligations unless otherwise stated in writing.

4.10 Immediate-Access Digital Products

Pre-designed training plans, downloadable programmes, and custom plans delivered immediately are non-refundable once delivered or accessed.

4.11 Consultations

These terms apply to consultations booked by prospective clients who are not currently enrolled in coaching services.

All consultations must be booked in advance and require full payment or a deposit to secure the appointment.

Any consultation fee or deposit may be deducted from the cost of coaching services if you choose to proceed.

Cancellations

  • Cancellations made more than 24 hours before the scheduled appointment are eligible for a full refund or reschedule

  • Cancellations made within 24 hours of the appointment are non-refundable

Rescheduling

  • Rescheduling requests must be made at least 24 hours in advance

  • Requests made within 24 hours will be treated as a late cancellation

  • A new booking and payment will be required

Non-Attendance

  • Failure to attend a scheduled consultation without prior notice will be treated as a no-show and is non-refundable.

Late Arrival

  • If you arrive late, the consultation will still end at the scheduled time.

By booking a consultation, you confirm that you have read and agreed to these Terms.

4.13 Price Changes

We reserve the right to adjust pricing at any time.

At least thirty (30) days’ written notice will be provided before any price increase takes effect.

Price changes will apply from the next billing cycle following the notice period.

Fixed-term subscriptions will retain the agreed price for the duration of the term.

If you do not agree to a price increase, you may cancel your subscription before the new pricing takes effect

4.14 Subscription Changes (Upgrades & Downgrades)

Where multiple subscription tiers are available, you may request to change your subscription level at any time by submitting written notice before your next billing date.

  • Upgrades may take effect immediately or from the next billing cycle, at our discretion. Where an upgrade takes effect mid-cycle, a pro-rated charge may apply.

  • Downgrades will take effect from the next billing cycle.

  • No partial refunds are provided for mid-cycle downgrades.

All subscription changes are subject to confirmation and may not alter any fixed-term payment obligations unless otherwise agreed in writing.

4.15 Cooling-Off Period (UK Consumer Contracts Regulations)

If you purchase services online, you have a legal right to cancel within fourteen (14) days without giving a reason under the Consumer Contracts Regulations 2013.

By purchasing our services, you expressly request that coaching services begin within this 14-day period.

You acknowledge that:

  • You may be charged for any services delivered before cancellation

  • Your right to cancel may be reduced or lost once services have been fully performed

To exercise your right to cancel, you must notify us in writing before the 14-day period expires.

4.16 Suspension & Termination

We reserve the right to suspend or terminate services where:

  • Payment is not received.

  • You breach these Terms.

  • You engage in abusive, threatening, or inappropriate conduct.

Termination does not remove your obligation to pay outstanding amounts.

4.17 Chargebacks

If you initiate a chargeback or payment dispute without first contacting us to attempt resolution:

  • Access to services may be immediately suspended

  • We reserve the right to dispute any unjustified chargebacks

We further reserve the right to recover any costs, fees, or losses incurred as a result of such chargebacks.


All content provided by Goddef Performance, including but not limited to training programs, workout plans, coaching materials, videos, guides, digital downloads, written materials, branding, logos, and social media content, is the intellectual property and copyright of Goddef Performance.

By purchasing, accessing, or using any materials provided by Goddef Performance, you agree to the following usage restrictions:

  1. Personal Use
    All content is provided strictly for your personal, non-commercial use. You may not use any content for business, commercial, or revenue-generating purposes.

  2. Reproduction & Distribution
    You may not copy, reproduce, republish, upload, post, transmit, distribute, share, sell, license, sublicense, or otherwise exploit any content in any format without prior written permission from Goddef Performance.

  3. Modification & Derivative Works
    You may not modify, adapt, translate, edit, reverse engineer, or create derivative works based on any content provided.

  4. Resale & Redistribution
    You may not resell, redistribute, share login access, or make the content available to third parties, whether for free or for payment.

  5. Public Display & Commercial Use
    Content may not be used for public display, commercial coaching, group training, gym programming, online coaching platforms, or any business-related activity without explicit written consent.

  6. Intellectual Property Protection
    All rights not expressly granted in writing remain reserved by Goddef Performance. Unauthorized use may result in termination of access and may lead to legal action.

By accessing or using any materials from Goddef Performance, you acknowledge that you understand and agree to comply with these usage restrictions.

Governing Law & Amendments

Personal data is processed in accordance with UK GDPR Regulations and Data Protection Act 2018.


These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. The most current version will always be available on our website. Continued use of services constitutes acceptance of any updates.
